Welcome to Puer et Senex LLC, doing business as Polysnifferous Perfumes (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website located at www.polysnifferous.com (the “Site”) and any related services, features, or content we provide (collectively, the “Services”). By accessing or using our Site, you (“user,” “you,” or “your”) acknowledge that you have read and agree to these Terms. If you disagree, please exit stage left—dramatically, if you wish.
1. ACCEPTANCE OF TERMS
1.1 Binding Agreement
By using the Site, you represent that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use our Site or Services.
1.2 Modifications
We may revise these Terms from time to time at our sole discretion. Any changes will be posted on the Site with a revised “Last Updated” date, and/or we may provide other forms of notice. Your continued use of the Site after such posting indicates acceptance of those changes.
2. ELIGIBILITY
2.1 Legal Age
You must be at least 18 years of age (or the age of majority in your jurisdiction) to use our Site. If you’re not there yet, patience, dear friend—our scents aren’t going anywhere.
2.2 Access Restrictions
We reserve the right to refuse service, cancel orders, or terminate user accounts at our discretion if we suspect violations of these Terms or any unlawful or inappropriate conduct.
3. ORDERS AND PAYMENT
3.1 Order Placement
When placing an order on the Site, you warrant that all information you provide is accurate, current, and complete. We reserve the right to refuse or cancel any orders if we suspect suspicious activity.
3.2 Pricing & Availability
Prices on our Site are in U.S. dollars and may change without notice. We work hard to keep our inventory updated, but sometimes a runaway best-seller might go out of stock unexpectedly. If that happens, we’ll notify you and either suggest an alternative or provide a full cancellation before shipping.
3.3 Payment Methods
We accept major credit cards, debit cards, and possibly more (check the Site for details). By submitting payment, you confirm you’re authorized to use the chosen payment method. If the method is invalid, we may cancel your order.
4. SHIPPING
4.1 Delivery
We typically ship from Parker, Colorado, to addresses within the U.S. and, where possible, internationally (subject to relevant shipping restrictions). Estimated costs and delivery times are presented at checkout. Actual delivery times may be affected by circumstances beyond our control—unexpected weather, alien invasion, etc.
4.2 Risk of Loss
Risk of loss passes to you once we hand your package off to the shipping carrier. If the shipping gremlins snatch it, let us know, and we’ll do our best to help you track it down.
5. NO RETURNS OR REFUNDS; CANCELLATIONS
5.1 No Returns or Refunds
We do not accept returns or offer refunds for any purchases. Please be sure you’re ready to commit to a new scent before you click that “Confirm” button.
5.2 Cancellations Before Shipping
We do, however, accept order cancellations if your order has not yet shipped. If you need to cancel, contact us immediately at jamieandnoahfragrances@gmail.com. If the order has already shipped, the sale is final—no refunds, no returns.
6. USE OF THE SITE
6.1 License to Use
We grant you a limited, revocable, non-exclusive license to access and use our Site for personal, non-commercial purposes. Don’t use sneaky bots or scraping tools to gather our content. It’s both uncool and against these Terms.
6.2 User Content
If you post reviews, comments, or any other content (“User Content”) on our Site, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, and display it. We reserve the right to remove anything that violates these Terms or common decency.
7. INTELLECTUAL PROPERTY
7.1 Our Content
The Site and its content (e.g., text, graphics, logos, images, software) are owned or licensed by Puer et Senex LLC (dba Polysnifferous Perfumes). We reserve all rights not expressly granted in these Terms.
7.2 Trademarks
All trademarks, service marks, and trade names (such as “Polysnifferous Perfumes”) are owned by us or our licensors. Please don’t use them without our express permission.
8. DISCLAIMER OF WARRANTIES
8.1 AS-IS Basis
Our Site, Services, and products are provided on an “AS IS” and “AS AVAILABLE” basis. While we strive for delightful experiences, we cannot guarantee perfection, uptime, or error-free operation.
8.2 No Warranty
We disclaim all warranties—express or implied—including merchantability, fitness for a particular purpose, and non-infringement. If you fail to impress that special someone even with our fragrances, that’s between you and your personal grooming routine.
9. LIMITATION OF LIABILITY
9.1 Extent of Liability
To the fullest extent permitted by law, Puer et Senex LLC (dba Polysnifferous Perfumes) and its affiliates, officers, employees, and agents will not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of (or inability to use) the Site or our Services.
9.2 Maximum Liability
If, despite our disclaimers, we’re found liable for any claim, our total liability will not exceed the amount you paid for the specific product(s) that gave rise to the claim.
10. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Puer et Senex LLC (dba Polysnifferous Perfumes) and its affiliates from any claims, liabilities, damages, losses, or expenses (including attorneys’ fees) resulting from your breach of these Terms or misuse of the Site.
11. GOVERNING LAW & DISPUTE RESOLUTION
11.1 Governing Law
These Terms and any disputes arising out of them are governed by the laws of the State of Colorado, without regard to its conflict of laws principles.
11.2 Venue
Any disputes relating to these Terms must be brought in the state or federal courts located in Douglas County, Colorado. By using our Site, you submit to the exclusive jurisdiction of these courts.
11.3 Informal Resolution
We’d prefer to settle any issues without dragging in the lawyers. If you have a concern, email us at jamieandnoahfragrances@gmail.com so we can try to work things out amicably.
12. CHANGES TO THE SITE
We reserve the right to modify, suspend, or discontinue any aspect of the Site or Services at any time. We’re continually experimenting with new fragrances and site features; sometimes that means shaking things up a bit.
13. SEVERABILITY
If any provision of these Terms is found unlawful, void, or unenforceable, that provision is severable and does not affect the validity and enforceability of the remaining provisions.
14. ENTIRE AGREEMENT
These Terms, together with any policies or legal notices posted on our Site (like our Privacy Policy), constitute the entire agreement between you and Puer et Senex LLC (dba Polysnifferous Perfumes) regarding your use of www.polysnifferous.com. They replace any prior or concurrent agreements, communications, or understandings.
